Terms of Service

These terms are the agreement between you and Cradlespeak ("Cradlespeak", "we") when you use the Cradlespeak application, this website, or the platform that sells language packs. By using any of them, you accept these terms.
1. What Cradlespeak is
Cradlespeak is a language-learning application for Android, optionally paired with a companion program for Windows, Mac or Linux. The application runs on your own device and holds your content there. Some parts are free permanently; some are unlocked by a one-time purchase.
2. No account, and what that means
There is no signup, no username and no password. Your device generates a key for itself and that key is your identity to us. This has a consequence worth stating plainly: if you lose the device and its backup, we cannot recover your identity for you, because we hold nothing that connects it to you. Make backups — the app writes them to your own Google Drive or a USB drive.
3. What you get when you buy
A purchase grants you a permanent, personal, non-transferable licence to use that content within Cradlespeak, on the number of devices stated at the time of sale — normally two for an individual purchase and ten for a family purchase. It is a licence to use, not ownership of the content, and it is not a subscription: there is nothing to cancel and nothing renews.
You may not:
- Resell, rent, sublicense or give away your purchase or its unlock codes.
- Work around the device limit, or the encryption protecting paid content.
- Extract the content in order to redistribute it, inside or outside the application.
The packaged files may be freely copied — that is by design, so you can install without a good connection. They are useless without a key you bought. Copying the files is fine; sharing your key is not.
4. Prices and payment
Paddle.com Market Ltd is the merchant of record for every Cradlespeak sale. They are the seller on your statement, they handle payment and tax, and their buyer terms apply to the transaction itself.
The price you are shown at checkout, in your currency and including any tax, is the price you pay. We may change prices for future sales; a change never affects something you have already bought.
5. Refunds
48 hours, automatic, no questions asked. The details — including the requirement that every device release a pack before the money moves — are on the refund policy page, which forms part of these terms.
6. Prepaid balance and AI features
Some optional features use large AI models that cannot run on a phone. These are paid from a prepaid balance you top up. Each action shows its price before you confirm it, and nothing spends your balance without you asking.
The balance is prepayment for those services, not a stored-value instrument or a payment account. It has no cash value beyond its use in Cradlespeak, cannot be transferred, and cannot be cashed out — except through the 48-hour refund described in the refund policy. AI output is generated by a machine: it can be wrong, and you should treat it as a study aid rather than an authority.
7. Content you bring in
Cradlespeak lets you import your own books, comics, podcasts and recordings so that the learning modes can teach from them. That material stays on your device and is never uploaded to us.
You are responsible for having the right to the material you import. Cradlespeak is a tool for studying content you already lawfully possess. It does not supply copyrighted material and provides no way to obtain it.
For the same reason, the application will not transfer imported books, comics, podcasts or video to another person's device. Lessons, summaries and other teaching material you author can be shared; the source media cannot. This limit is built into the software, and it is deliberate — moving a copyrighted book from one person to another is distribution, whatever the intent behind it.
8. If you author and sell content
You may submit content to the Cradlespeak marketplace. If you do:
- You keep ownership of what you wrote, and grant us the licence needed to package, distribute and sell it within Cradlespeak.
- You warrant that it is yours to sell and that it infringes nobody's rights.
- The revenue split is 70% to you, 30% to us, paid out after any refund window has closed.
- A separate author agreement applies and must be accepted before your first submission.
- We may decline or delist content that breaches these terms, infringes someone's rights, or fails our automated checks. If we delist yours, we will tell you why.
9. Acceptable use
Do not:
- Break, probe or overload the platform, or try to reach parts of it that are not yours.
- Use Cradlespeak to distribute material you have no right to distribute.
- Submit content that is unlawful, or that harasses or endangers anyone.
- Automate abuse of the AI features, or resell access to them.
If you do these things we may suspend the identity involved. Where we do, and you have paid for something, we will still honour the refund policy for anything inside its window.
10. Availability
The application runs on your device and does not need us to be online — that is the point of the design. The platform that sells packs and serves AI features is a small operation and may be unavailable at times. We do not promise a particular uptime for it. If it is down when you try to redeem something you have paid for, that is our problem to fix, and the refund window will not be used against you.
11. Warranty
Cradlespeak is provided as it is. We do not promise it is free of defects, nor that it will make you fluent — that depends on work only you can do. To the extent the law allows, we exclude implied warranties. Nothing here removes rights your local consumer law gives you.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for lost data where you had the means to back it up and did not. Our total liability for any claim is limited to what you paid us in the twelve months before it arose.
Some jurisdictions do not allow these exclusions. Where that is so, they do not apply to you.
13. Changes to these terms
We may update these terms. The date at the top changes when we do. A change never retroactively alters a purchase you have already made — the terms you bought under continue to govern it.
14. Ending it
You may stop using Cradlespeak at any time; uninstalling is enough. Your purchases remain valid for as long as you keep your identity key. If we ever stop operating the platform, we will give notice and make what you have bought usable offline, since the application already runs without us.
15. Governing law
These terms are governed by the laws of the State of New Mexico, United States of America, and the courts there have jurisdiction — without depriving you of the protection of the consumer law of the country where you live.
